§1 INTRODUCTORY PROVISIONS
The online store STRAPSPOT, accessible at www.strapspot.com, is managed by Daniel Mikrut, conducting business under the name Daniel Mikrut Strapspot, registered in the Central Register and Information on Economic Activity (CEIDG) maintained by the minister responsible for the economy, with the tax identification number NIP: 8722447708, REGON: 528042917.
These Terms and Conditions are intended for both Consumers and Entrepreneurs using the Store and outline the rules for utilizing the online Store and the terms for concluding distance sales agreements with the Customer through the Store.
§2 LEGAL DEFINITIONS
Consumer – a natural person concluding a contract with the Seller within the Store, where the subject is not directly related to their business or professional activity.
Seller – a natural person operating under the name Daniel Mikrut Strapspot, registered in the Central Register and Information on Economic Activity (CEIDG), with NIP: 8722447708, REGON: 528042917.
Personal Data – any information concerning an identified or identifiable natural person. Information does not identify a person if it requires excessive costs, time, or actions to identify.
Client – an adult natural person with full legal capacity, a legal entity, or an organizational unit without legal personality but possessing legal capacity, who purchases from the Seller for purposes directly related to their business or professional activity.
Entrepreneur – a natural person, legal entity, or organizational unit without legal personality but granted legal capacity by a separate law, conducting business activities in their own name and utilizing the Store.
Store – the online store operated by the Seller at www.strapspot.com.
Distance Agreement – an agreement concluded with the Client as part of an organized system for concluding distance contracts (within the Store), without the simultaneous physical presence of the parties, using one or more means of distance communication until the contract is concluded.
Civil Code – the Civil Code Act of April 23, 1964, as amended.
Product Basket – a list of products created from the available products in the store based on the Client's choices.
Product – an item available in the Store that is the subject of the Sales Agreement between the Client and the Seller. The items sold are used or collectible. The goods offered in the store may be pre-owned, returned, or display items but will not show signs of wear. We ensure that the shoes you receive are always in perfect condition.
Sales Agreement – the sales agreement of a Product concluded or entered into between the Client and the Seller through the online Store.
Privacy Policy – rules for processing Clients' personal data by the Data Administrator, Client rights, and Administrator obligations, available on the Seller's website.
Consumer Law – the Consumer Rights Act of May 30, 2014 (Dz. U. 2014, item 827, as amended).
Terms and Conditions – this document.
Order – a declaration of the Customer's intent submitted through the Seller, clearly specifying the type and quantity of products, delivery method, payment type, delivery location, and Client's details, aiming to conclude a sales contract.
Personal Data – as defined in Article 4(1) of Regulation (EU) 2016/679 of the European Parliament and Council of April 27, 2016, on protecting natural persons regarding personal data processing and the free movement of such data (GDPR), referred to as "Regulation 2016/679."
Product Usage – the specified range of use or application of the product as defined by the seller.

The Client can contact the Seller via email, social media accounts, or phone as provided in this section.
The Client may contact the Seller by phone from Monday to Friday, 9:00 AM – 4:00 PM, or by email or Instagram message 24/7.
§4 TECHNICAL REQUIREMENTS
To use the Store, including browsing its assortment and placing product orders, the Client must:
a. Use a device with Internet access.
b. Use one of the following web browsers: Firefox, Safari, Google Chrome, or Opera.
c. Have cookies enabled.
d. Have an active email account.
§5 GENERAL TERMS
To the broadest extent permitted by law, the Seller is not responsible for interruptions in the operation of the Store caused by force majeure, unauthorized third-party actions, or incompatibility of the online Store with the Client’s technical infrastructure.
Browsing the Store’s assortment does not require creating an account.
Orders can be placed by providing an email address and necessary personal and delivery details and accepting these Terms and Conditions.
All prices provided by the Seller are in Polish currency and are gross prices.

Orders can be placed via the Store 24 hours a day, 365 days a year.
§5A SEARCH AND PRODUCT FILTERING
The Buyer has the right to filter products during their search by clicking on the "SORT BY" tab.
The Buyer has the right to use the following filters:
a. Recommended: Means filtering based on the number of individual page visits for a given product and the number of units sold in the last month.
b. New Arrivals: Means filtering based on the date the product was added to the website.
c. Price from Lowest to Highest: Means filtering based on the price given in PLN, which is the gross amount.
d. Price from Highest to Lowest: Means filtering based on the price given in PLN, which is the gross amount.
e. Name from A to Z: Means filtering based on the product name alphabetically.
f. Name from Z to A: Means filtering based on the product name alphabetically.
The default filter applied after clicking on the "ALL PRODUCTS" tab is the "New Arrivals" filter.
§5B PRODUCT PURPOSE AND USAGE RULES
The product's purpose is defined by the seller and refers to the intended use of the product, which may vary depending on the model.
Failure to adhere to the product's intended use and the proper usage guidelines provided by the seller may result in mechanical damage that is not covered by the warranty.
§5C TERMS USED ON THE WEBSITE
The seller uses the following symbols, terms, and icons on the website, each with a specific meaning, including:
a. "HOT" – A product that is gaining in popularity.
b. "24H" – A product that is shipped within 24 hours after the order is placed.
c. "SALE" – A product that is on sale.
§5D PROMOTIONS AND SALES
For each offer that is part of a promotion or sale, the seller will provide information regarding the previous price applied by the seller to the given product.
The previous price refers to the lowest price applied by the seller within the 30 days prior to the discount.
If the discount on a product occurs less than 30 days after it was added to the website, the provisions of point 2 still apply.

The Client may choose the following delivery or pickup methods for the ordered product:
a. DPD Courier Delivery
b. InPost Parcel Locker Delivery
The Client may use the following payment methods:
a. Bank transfer to the Seller's account
b. Electronic payments via Tpay
c. Credit card payment (via Stripe)
d. Cash on delivery
Detailed information about the delivery methods and acceptable payment methods can be found on the Store's website.
§7A REVIEWS
Only a person who has made a purchase is entitled to submit a review about the store.
Only a person who has purchased a specific product is entitled to leave a comment or review for that product.
The Seller verifies the authenticity of reviews and comments specified in points 1 and 2 based on personal data obtained during the conclusion of the contract.

SALE AGREEMENT PERFORMANCE
a. bank transfer, electronic payment, or credit card payment, the Client is obliged to make the payment within 3 (three) calendar days from the date of the Sale Agreement - otherwise, the order will be canceled.
a. If the Client chooses bank transfer, electronic payment, or credit card payment - from the date the Seller's bank account is credited.

The statement can also be submitted using a form, the template of which is attached as Appendix No. 1 to these Terms and Conditions, as well as to the Act of May 30, 2014, on Consumer Rights, though this is not mandatory.
a. In the event of withdrawal from a distance Agreement, the Agreement is considered void.
b. The Seller will refund the Consumer promptly, no later than within 14 days from receiving the Consumer's statement of withdrawal, all payments made by the Consumer, including the cost of delivery, except for any additional costs incurred if the Consumer selected a delivery method other than the cheapest standard method offered by the Seller.
c. The refund will be made using the same payment methods used by the Consumer in the original transaction unless the Consumer agrees to another method, which will not incur any costs for the Consumer.
d. The Seller may withhold the refund until the Product is returned.
e. The Consumer should return the Product to the Seller's address provided in these Terms and Conditions immediately, but no later than 14 days from the date the Consumer informed the Seller about the withdrawal. The deadline is met if the Consumer sends the Product back before the 14-day period expires.
f. The Consumer bears the direct costs of returning the Product, including costs if the Product cannot be returned by regular mail due to its nature.
g. The right to withdraw from the Agreement may only be exercised by the Consumer if the product has not been used and shows no signs of use.

PERSONAL DATA

d. delivering the ordered Product,
e. exercising all consumer rights (e.g. withdrawal from the agreement),
f. verifying comments and reviews specified in §7a.
a. In the case of a Customer using courier delivery or Inpost parcel locker services, the Administrator shares the collected personal data with the chosen carrier or intermediary responsible for delivering shipments on behalf of the Administrator.
b. In the case of a Customer using electronic payment methods such as Tpay, PayPal, or credit cards, the Administrator shares the collected personal data with the entity processing these payments for the online store.
